Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Lunar Cycles mobile application (the “App”) provided by Tortato (“we”, “us”, or “our”). By installing or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.

01 · License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial use on devices you own or control.

02 · Restrictions

You agree not to:

  • Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
  • Resell, sublicense, lease, or otherwise commercially exploit the App.
  • Remove, alter, or obscure any proprietary notices.
  • Use the App in any unlawful manner or in violation of any third-party rights.

03 · In-App Purchases

The App offers a single optional one-time premium purchase (Lunar Cycles Premium Lifetime) that removes advertisements. This is a non-recurring purchase. There are no subscriptions, no auto-renewal, no trial periods, and no recurring billing.

All transactions are processed by Apple App Store In-App Purchase (on iOS) or Google Play Billing (on Android). Refunds, where applicable, are governed by the respective store's policies.

04 · Intellectual Property

The App, including all content (other than user-generated content stored locally on your device), graphics, code, and trademarks, is owned by Tortato or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use any name, logo, or trademark of Tortato.

05 · Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Astronomical computations are provided for general informational purposes only and are not intended for scientific navigation, mission-critical timing, or research-grade precision.

06 · Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TORTATO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

07 · Termination

These Terms apply for as long as you use the App. You may terminate at any time by uninstalling the App. We may suspend or terminate your license if you breach these Terms. Upon termination, the license granted to you ends and you must stop using the App.

08 · Changes

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

09 · Governing Law

These Terms are governed by the laws of Brazil, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the courts of Brazil, unless mandatory consumer-protection laws of your country of residence provide otherwise.

10 · Apple App Store Additional Terms

If you obtained the App from the Apple App Store, the following additional terms apply, and in case of conflict, prevail over the corresponding clauses above:

  • These Terms are concluded between you and Tortato only, and not with Apple. Apple is not responsible for the App or its content.
  • The license granted is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to furnish maintenance or support for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, which will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for any third-party claims relating to the App or your use of it.
  • Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
